Probate is the legal process of distributing a decedent’s assets to his/her beneficiaries. It is during Probate that the Court appoints a personal representative to handle the estate. This person is responsible for paying the estate’s debts, documenting assets, and distributing those assets to the beneficiaries. The personal representative is typically named in the decedent’s Will. Probate can be formally supervised by the Court, or, under the right circumstances, can be done informally through the Court.
